PROCEDURAL JUDICIAL PROTECTION OF TRADE SECRETS

Abstract

Public pleading is one of the most important principles of the right to litigation guaranteed by the 2005 Iraqi Permanent Constitution, and regulated by the mother law of all procedural laws (the Iraqi Civil Procedure Code). The principle of publicity of litigation procedures also includes minutes of sessions as well as judgments in terms of the publicity of their pronouncement and publication and the opportunity for everyone to view them. However, the matter is different with regard to lawsuits for protecting trade secrets, which have specificity in litigation and the Latin and Anglo-American schools. The principle of confidentiality of pleading can be applied as an exception to the general principle of publicity.
